The EU offers a suitable milieu for the comparison and harmonisation of healthcare across different languages, cultures, and jurisdictions, which could provide improvements in healthcare standards across the bloc. There are specific ethico-legal issues with the use of data in healthcare research that mandate a different approach from other forms of research. The use of healthcare data over a long period of time is similar to the use of tissue in biobanks. There is a low risk to subjects but it (...) is impossible to gain specific informed consent given the future possibilities for research. Large amounts of data on a subject present a finite risk of re-identification. Consequently, there is a balancing act between this risk and retaining sufficient utility of the data. Anonymising methods need to take into account the circumstances of data sharing to enable an appropriate balance in all cases. There are ethical and policy advantages to exceeding the legal requirements and thereby securing the social licence for research. This process would require the examination and comparison of data protection laws across the trading bloc to produce an ethico-legal framework compatible with the requirements of all member states. Seven EU jurisdictions are given consideration in this critique. (shrink)

This paper assesses Michael Brady’s claim that the ‘capture and consumption of attention’ in an emotion facilitates evaluative understanding. It argues that emotional attention is epistemically deleterious on its own, even though it can be beneficial in conjunction with the right epistemic skills and motivations. The paper considers Sartre’s and Solomon’s claim that emotions have purposes, respectively, to circumvent difficulty or maximize self-esteem. While this appeal to purposes is problematic, it suggests a promising alternative conception of how emotions can be (...) teleological. The fact that emotional attention manifests dispositions, which have been habituated by repeated association with pleasure or relief, explains how the emotion can acquire the function of producing pleasure or relief. Hence, the emotion can have ‘non-cognitive function,’ in which its patterns of attention reliably produce beliefs that disregard or distort the truth. Not only is non-cognitive function the default condition of emotion prior to any training, but even those who have successfully trained their emotions often revert back to non-cognitive function when faced with trauma or stress. Many have thought that exercises of skill are intentional. The argument of the paper is that this thesis fails to account for important types of mistakes and errors. In what psychologists and linguists call “verbal slips with semantic bias”, a speaker mistakenly switches, reverses, or blends certain conceptual contents. Nevertheless, the speaker has successfully exercised an intellectual skill, insofar as her slip uses concepts in conformity to semantic and logical rules. To flesh out how one might successfully exercise skills without (...) doing so intentionally, the paper appeals to the idea of habit. Verbal slips thus show how human skillfulness has a considerably wider scope than is often supposed. (shrink)

The arguments levelled by J L Mackie against objective values and moral realism still have sway over many philosophers. In this paper I carefully analyze these arguments. My analysis covers the following areas: 1) his notion of objective value, 2) his metaethical methodology, 3) his attempt at outlining a normative ethics in light of his metaethical skepticism, and 4) his understanding of the concept "institution". I conclude that a version of moral realism can be maintained in the face of Mackie's (...) arguments. I offer a moral realist rejoinder to each of the four above areas and the rebuttals culminate into a thesis I call contextual moral realism. (shrink)

One foundation of Eliminative Materialism is the claim that the totality of our ordinary resources for explaining and predicting behaviour, ?Folk Psychology?, constitutes a theoretical scheme, potentially in conflict with other theories of behaviour. Recent attacks upon this claim, as well as the defence by Paul Churchland, are examined and found to be lacking in a suitably realistic conception of theory. The skepticism of purandara is examined to illustrate the carvaka position. The often turbulent but nevertheless short history of psychology as a science reveals a strange and often strained relationship with its parent, philosophy. Martin Heidegger played a prominent role in the developing dialogue between philosophy and psychology in this country. As such, he was identified as a principal contributor to the philosophy of existentialism. And Ludwig Binswanger was seen as being the bridge between existential philosophy and psychotherapy. Heidegger's method of inquiry, meticulously thought through and developed, has become an eloquent (...) expression of man's never-ending search for knowledge and the clarification of what "is." This method, along with the scope of his questioning, has generated the development of a phenomenological foundation for medicine and psychology. In this paper, the author attempts to demonstrate Heidegger's work as remarkably poignant for the human condition. He shows how Binswanger, seeing and sensing these new insights, nevertheless remained captive to traditional expressions of thought. One of the most important concepts in the field of political ethics is the idea of a moral dilemma – understood as a situation in which an agent’s public responsibilities and moral imperatives conflict in such a way that no matter what the agent does she will in some way be committing a moral wrong. In the aftermath of the events of September 11, 2001, the notion of a moral dilemma has undergone a profound reconceptualization in American political discourse, and (...) there has perhaps been no more important cultural forum for that conceptual revision than the quintessential post-9/11 melodrama, FOX Television’s 24. This paper first describes and then critically evaluates America’s new model moral dilemma as portrayed on 24. Focusing specifically on 24’s Season Five (the year the show won the Emmy for Best Dramatic Series), the paper shows how 24’s creators have substituted in the public mind almost a parody of the standard philosophical account of a moral dilemma in place of the traditional notion. Their methods for this conceptual revision have included both an extravagant, even baroque portrayal of the grand dilemmas which confront Jack Bauer and his fellow patriots, on the one hand, and on the other, a subtle de-valuing of the moral stakes in the more pedestrian variety of moral conflicts Bauer and company must overcome in their quest to keep America safe whatever the cost.
